1. Acceptance of Terms
By downloading, installing, or using OP TCG Dex (the "App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. OP TCG Dex reserves the right to update or modify these Terms at any time without prior notice, except that changes to the price of an existing subscription are governed by Section 3.7, which requires advance notice. Continued use of the App after such modifications constitutes your acceptance of the updated Terms.
2. Use of the App
2.1 License: OP TCG Dex grants you a non-exclusive, revocable, non-transferable license to use the App for personal, non-commercial purposes.
2.2 User Conduct: You agree not to engage in any activity that may interfere with or disrupt the functionality of the App, including but not limited to hacking, reverse engineering, or attempting to gain unauthorized access to the App.
3. Purchases and Subscriptions
3.1 Subscription Plans: OP TCG Dex offers a PRO subscription service available in two plans: monthly and annual. Prices vary per country and may change over time, and the plans offered may change over time. Check the current price in the app. Subscribers who joined under an earlier price may remain on that price until it is changed in accordance with Section 3.7.
3.2 PRO Benefits: By subscribing to the PRO service or purchasing Lifetime PRO, users gain access to the following benefits: (1) Increase base deck and vault sizes to 50 each, (2) Currency converter, (3) Add notes to cards and decks, (4) Access to deck statistics and charts, (5) Cardmarket price data, (6) Unlimited card scans, and (7) Remove ads. The benefits included in PRO may be added to, changed, or replaced over time as the App develops.
3.3 Lifetime PRO: OP TCG Dex offers a one-time Lifetime PRO purchase. Lifetime PRO provides the same PRO benefits listed above for the life of the App on the account used to complete the purchase. Lifetime PRO is billed once and does not automatically renew. Prices vary per country and may change over time. Check the price in the app. OP TCG Dex may withdraw Lifetime PRO from sale at any time. If it is withdrawn, users who purchased it beforehand keep their Lifetime PRO benefits.
3.4 Remove Ads: OP TCG Dex offers a one-time Remove Ads purchase that removes advertisements from the App. Remove Ads does not include the other PRO benefits listed in section 3.2. Remove Ads is billed once and does not automatically renew. Prices vary per country and may change over time. Check the price in the app. OP TCG Dex may withdraw Remove Ads from sale at any time. If it is withdrawn, users who purchased it beforehand keep their ad-free access.
3.5 Billing and Payment: Subscriptions will be billed either monthly or annually, depending on the chosen plan. One-time purchases (Lifetime PRO and Remove Ads) are billed once at the time of purchase. Payments will be processed through the app store from which the App was downloaded. Subscriptions will automatically renew unless canceled at least 24 hours before the renewal date. One-time purchases do not renew.
3.6 Cancellation and Refunds: You may cancel your PRO subscription at any time through your account settings in the App Store for iOS users and Google Play for Android users. No refunds will be provided for any unused portion of the subscription term. One-time purchases are non-refundable except where required by applicable law or the refund policies of the App Store or Google Play.
3.7 Price Changes: OP TCG Dex reserves the right to change the price of any subscription plan, including increasing the price of an existing subscription. We may increase prices to reflect increases in our operating costs, including card data licensing, image hosting, payment processing, and third-party service fees, and to fund continued development of new features and support for additional trading card games. If we increase the price of your existing subscription, we will give you advance notice of at least 30 days, or a longer period where required by your local law or by the app store you purchased through. That notice will be shown to you inside the App and will state the name of your subscription, your current price, the new price, the date the new price takes effect, and how to cancel. The new price will apply from your first renewal on or after that effective date. You may cancel at any time before then through the App Store or Google Play, and you will not be charged the new price. Where your local law or app store requires your consent to a price increase, your subscription will not renew at the new price unless you provide that consent.
3.8 Advertising: The App may display advertisements to users who do not have an active PRO subscription or an applicable one-time purchase. The App may also offer optional rewarded advertisements that temporarily unlock selected PRO features in exchange for viewing them. Viewing rewarded advertisements is always optional, grants only the benefit described at the time of the offer, and does not create a subscription.
4. Data Collection and Privacy
4.1 User Sign-In: The App offers user sign-in options through Google Sign-in and Apple Sign-in. By signing in using these methods, you consent to the collection and use of your provided information as outlined in these Terms of Service and the Privacy Policy.
4.2 Information Collected: OP TCG Dex may collect non-sensitive personal information such as your email address (provided by Google or Apple), display name (optional), and region (optional).
4.3 Usage of Collected Information: The collected information may be used for account creation, communication related to your account, providing personalized content, and improving user experience within the App.
4.4 Third-Party Services: The App may utilize third-party analytics services. Your use of these services is subject to their respective privacy policies.
5. Data Privacy and Security
5.1 Data Security: OP TCG Dex is committed to protecting your data and will handle it securely in accordance with applicable data protection laws.
5.2 No Sensitive Information: OP TCG Dex does not collect sensitive personal information, such as financial data or personally identifiable information beyond what is necessary for app functionality.
6. Updates and Changes
OP TCG Dex may release updates, modifications, or new features for the App. Continued use of the App after such updates constitutes your acceptance of the changes.
7. Disclaimer of Warranty
The App is provided "as is" without any warranty, and OP TCG Dex disclaims all warranties, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
8. Limitation of Liability
In no event shall OP TCG Dex be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App.
9. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Philippines, and users agree to submit to the exclusive jurisdiction of the courts in that jurisdiction.
